Booking Website Pro Add-On Service Terms
These terms govern your use of the Booking Website Pro Add-On Service ("Booking Website Pro") and form an integral part of the Agreement, including the Hostaway Terms of Service. Capitalised terms not defined herein have the meanings given in the Terms of Service.
1 SERVICE DESCRIPTION
1.1 Booking Website Pro is an Add-On Service that allows the Customer to create and publish a customisable, public-facing direct booking website integrated with the Hostaway Service.
1.2 The Customer retains full control over the content, design, and configuration of their Booking Website Pro, subject to Hostaway's acceptable use policies and the Terms of Service.
1.3 The Booking Website Pro is provided "AS IS" and "as-available." Hostaway does not guarantee any specific level of uptime or uninterrupted availability and shall not be liable for any loss of bookings, revenue, or business opportunity resulting from downtime or interruptions.
2 CUSTOMER RESPONSIBILITIES
2.1 The Customer's use of the Booking Website Pro is subject to the Hostaway Terms of Service, including, without limitation, the Customer's responsibilities in respect of Customer Data, Hostaway's non-liability for transactions and the Customer's obligations as Controller of Personal Data. All bookings are direct transactions between the Customer and the guest. Hostaway is not a party to any such booking and has no liability in connection with it. The Customer must ensure that their use of the Booking Website Pro complies with all applicable laws and regulations, including consumer protection, e-commerce, data protection, and accessibility requirements.
2.2 The Booking Website Pro includes tools such as a cookie banner or consent management tool. Hostaway may also insert analytics cookies or tracking technologies in connection with delivering the service. The Customer remains the data controller and is solely responsible for ensuring all cookies, tracking technologies, and consent tools are configured and used in compliance with applicable law, including e-privacy obligations.
3 BILLING AND CHARGES
3.1 The Booking Website Pro is subject to the fees set out in the Agreement or, where the Customer activates the Booking Website Pro via the Hostaway Service, as set out in the Customer's Hostaway account or as otherwise communicated to the Customer before activation. By activating the Booking Website Pro, the Customer accepts the applicable fees, including any Booking Website Pro Minimum.
3.2 The Customer is charged for each published Booking Website Pro instance. Unpublished or draft instances are not billed, save where Section 3.3 applies.
3.3 Where the Agreement specifies a minimum commitment for Booking Website Pro ("BWP Minimum"), the following applies:
(a) The BWP Minimum applies per Booking Website Pro instance, not per listing or Accommodation;
(b) The BWP Minimum is charged from the commencement of the Contract, regardless of whether any Booking Website Pro instance has been created, configured, or published. For the avoidance of doubt, the BWP Minimum is a recurring charge that accrues irrespective of the Customer's use of the Booking Website Pro; and
(c) The amount billed is calculated as the greater of: (i) the number of Booking Website Pro instances the Customer has published; and (ii) the BWP Minimum.
3.4 In addition to the charges set out above, a per-reservation service fee may apply to reservations made through the Booking Website Pro, as set out in the Agreement or the Customer's Hostaway account.
4 DOMAINS
The Customer may connect a custom domain to their Booking Website Pro or use a subdomain provided by Hostaway. The Customer is solely responsible for the registration, renewal, and DNS configuration of any custom domain used. Hostaway reserves the right to modify or reassign any Hostaway-provided subdomain at any time. Hostaway is not responsible for any domain-related issues, including but not limited to domain expiry, misconfiguration, or third-party DNS failures.
5 TERMINATION AND SERVICE CONTINUITY
5.1 The Booking Website Pro may be cancelled or terminated as follows:
(a) Where the Booking Website Pro is included in the Agreement with a BWP Minimum or a fixed Subscription Term (e.g., annual), cancellation or termination is subject to the termination provisions of the Agreement, including any applicable early termination charges. The Customer may not cancel the Booking Website Pro independently of the Agreement during the Subscription Term without paying any remaining BWP Minimum charges due for the remainder of the Subscription Term.
(b) Where the Customer has activated the Booking Website Pro via the Hostaway platform without a BWP Minimum or fixed term, the Customer may cancel the Booking Website Pro at any time. Cancellation will take effect in accordance with the billing cycle applicable to the Customer's account.
5.2 Upon cancellation or termination of the Booking Website Pro, regardless of the activation path:
(a) The Customer's access to the Booking Website Pro will cease upon the effective date of cancellation or termination;
(b) Any public-facing website or interface enabled by the Booking Website Pro will be taken offline;
(c) Any reservations made before the effective date of cancellation or termination will be retained in the Customer's Hostaway account; and
(d) The Customer is solely responsible for notifying guests and managing any bookings made before cancellation or termination.
5.3 Any outstanding fees, including accrued BWP Minimum charges, up to the effective date of cancellation or termination, remain due and payable in accordance with the Agreement.
5.4 Hostaway will use reasonable efforts to provide at least 30 days' prior written notice if the Booking Website Pro is to be discontinued by Hostaway. Hostaway shall not be liable for any loss of revenue, bookings, or business opportunity arising from such discontinuation.
